1. Scope
These Terms & Conditions apply to all orders placed by consumers via the online shop curated0049.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

3. Products
The products offered in this shop are secondhand and vintage items.
Due to their pre owned nature, items may show signs of wear, aging, or minor imperfections. Any noticeable defects or characteristics affecting the condition of the item are described as accurately as possible in the product description and/or shown in product images.
Such signs of wear do not constitute a defect if they are consistent with the described condition of the item.
4. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By submitting an order, the customer makes a binding offer to purchase the items in the shopping cart. A purchase contract is concluded once the seller confirms the order by email.
5. Prices
All prices are stated in euros and are final prices.
In accordance with §25a of the German VAT Act (UStG), the margin scheme for secondhand goods is applied. VAT is therefore not shown separately on invoices.
Any applicable shipping costs are displayed during the checkout process before the order is completed.
6. Payment
Payment can be made using the payment methods offered in the shop, in particular:

Credit or debit card payments via Stripe
Payment processing is carried out by the respective payment service providers.
7. Delivery
Delivery is made to the address provided by the customer during checkout.
Delivery times stated in the shop are estimates unless expressly stated otherwise. Delays may occur due to circumstances beyond the seller’s control.
8. Retention of Title
The goods remain the property of the seller until full payment has been received.
9. Right of Withdrawal
Consumers have a statutory right of withdrawal in accordance with EU consumer protection law.

10. Returns and Condition of Returned Goods
Returned items will be carefully inspected upon receipt.
A full refund will only be granted if the item is returned in the same condition as when originally shipped, taking into account only what is necessary to inspect the nature, characteristics, and functioning of the goods.
If the returned item shows additional signs of wear, damage, staining, odors, or alterations that go beyond normal inspection, the seller reserves the right to deduct an appropriate amount for loss in value or to refuse a full refund in accordance with applicable law.
11. Warranty (Defects Liability)
Statutory warranty rights apply.
For secondhand goods, the limitation period for claims based on defects is one year from delivery of the goods, unless mandatory legal provisions provide otherwise.
This limitation does not apply in cases of intentional misconduct, gross negligence, or where a guarantee has been expressly given.
Normal wear and tear or damage caused by improper use, care, or handling after delivery does not constitute a defect.
12. Liability
The seller is fully liable for damages caused by intent or gross negligence.
In cases of slight negligence, the seller is liable only for breaches of essential contractual obligations and limited to foreseeable, typical damages.
Liability for injury to life, body, or health remains unaffected.
13. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

The seller is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Governing Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), provided that this does not deprive consumers of mandatory protections under the laws of their country of residence.
15. Amendments to These Terms
The seller reserves the right to amend these Terms & Conditions to reflect legal changes or changes in business operations. The version applicable at the time of the order shall apply.
